Top Questions In Minnesota Divorce – Property Division

Minnesota Divorce and Property Division

In Minnesota Divorce cases, the division of assets and debts is a process that requires financial expertise and attention to detail; the division of assets does not need to be mathematically equal, and you are not necessarily entitled, under Minnesota law, to one-half of the marital assets.  In many Divorce cases, the parties agree to divide the property and assets equally; however, the division of assets need not be equal, only equitable (and the same rule applies to the division of marital debts).

Hire an Experienced Law Firm

A Divorce lawyer should have substantial financial acumen and training, including the ability to prepare a balance sheet that identifies the present value of assets and debts.  Also, your lawyer should understand brokerage accounts, including asset allocation, mutual funds and stocks.  In some cases, it is necessary to work with a CPA and occasionally an Actuary or Real Estate Appraisal in order to provide valuations of various assets, including 401k, 403b, related Qualified Plans, IRA, brokerage accounts, businesses as well as pensions and real estate.
